Welcome to TAGZ! These Terms and Conditions ("Terms") govern your use of the TAGZ mobile applications (available on iOS and Android) and website (collectively, the "Service"). TAGZ is a mobile app designed to help hunters plan their big game hunts across multiple states.

1. Privacy Policy

Please review our Privacy Policy, which governs how we collect, use, and protect your personal information.

2. Eligibility

By using TAGZ, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Service Description

TAGZ is a hunt-planning and draw strategy tool that helps users:

  • Receive recommendations based on hunting draw trends and regulations
  • Track preference points and draw results across species and states
  • Search and filter hunting units and tags
  • Set trip budgeting goals and view estimated costs
  • Get alerts about deadlines, draw results, and changes in hunt status
  • Access personalized dashboards for planning

TAGZ does not submit applications on your behalf, guarantee outcomes, or assume responsibility for your decisions regarding preference points, tag choices, or draw strategies. All recommendations are for informational purposes only.

4. User Responsibilities

You are responsible for:

  • Providing accurate information and maintaining your account credentials
  • Complying with all applicable laws and regulations
  • Submitting your hunting applications independently through official state websites
  • Using the Service in accordance with these Terms

5. Account Security

You agree to:

  • Keep your account credentials (e.g., email and password) secure
  • Notify us immediately if you suspect unauthorized access or use of your account
  • Accept responsibility for all activities under your account

We are not liable for any losses caused by unauthorized access resulting from your failure to safeguard login credentials.

6. Payments and Subscriptions

By using any paid features of the Service, you agree to pay all applicable fees according to the payment schedule active at the time of your sign-up. Subscriptions or in-app purchases are processed via Apple App Store, Google Play, or Stripe.

Subscriptions may auto-renew unless canceled before the renewal date. You are responsible for canceling subscriptions if you no longer wish to be charged. Refunds are not provided for subscriptions unless required by law.

All payment disputes must be directed to support@mytagz.me within 30 days of the charge. We reserve the right to suspend access to paid features for accounts with outstanding payment issues.

7. Intellectual Property

All content, features, design, logos, algorithms, and software associated with TAGZ are the exclusive property of TAGZ or its licensors and are protected under applicable copyright, trademark, and other intellectual property laws.

8. Prohibited Conduct

You agree not to:

  • Reverse engineer, decompile, disassemble, or tamper with the software
  • Scrape, mine, or harvest data in bulk or through automation
  • Circumvent access controls or attempt unauthorized access to systems
  • Use the Service for resale, white-labeling, sublicensing, or commercial redistribution
  • Use automated bots or high-frequency request patterns that degrade system performance
  • Attempt to clone or mimic the user interface, branding, or service logic
  • Abuse the Service by performing excessive queries or downloads without prior agreement (we reserve the right to enforce reasonable rate limits)

Examples of prohibited uses include: using TAGZ data to misrepresent hunting applications to state agencies, automating excessive queries (e.g., >1,000 searches/hour) that strain our servers, or reselling TAGZ features or data.

TAGZ reserves the right to suspend or restrict access if usage patterns suggest abuse, scraping, or other suspicious automated activity.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

  • The information provided is complete, accurate, or up-to-date
  • The Service will meet your specific expectations
  • Your access will be uninterrupted, timely, or error-free

All recommendations and predictions are generated based on historical trends and public data. These are not guarantees or promises of outcomes.

10. Limitation of Liability

To the fullest extent permitted by law, TAGZ and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, revenue, profits, or opportunities arising from your use of the Service.

11. Indemnification

You agree to indemnify, defend, and hold harmless TAGZ, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, and costs arising from your use of the Service or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason including but not limited to violations of these Terms or actions that may harm the Service or other users. To request account deletion, contact support@mytagz.me.

13. Force Majeure

TAGZ is not liable for delays or failures in providing the Service due to events beyond our control, including but not limited to natural disasters, server outages, or changes in state hunting regulations.

14. Governing Law

These Terms are governed by the laws of the State of New York. All legal proceedings shall be brought in the state or federal courts located in Erie County, New York, and you consent to their jurisdiction.

15. Dispute Resolution

Any dispute arising from these Terms shall be resolved through binding arbitration under the American Arbitration Association's rules in Erie County, New York. Each party will bear its own arbitration costs unless otherwise determined by the arbitrator.

16. Changes to These Terms

We may update these Terms from time to time. When changes are made, we will revise the "Last Updated" date and notify you of material changes via email, in-app notice, or on https://www.getmytagz.com/. Continued use of the Service after changes constitutes acceptance of the revised Terms.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices posted within the Service, constitute the entire agreement between you and TAGZ and supersede all prior agreements regarding your use of the Service.
